Customer agreement
Terms of Service
These terms govern your use of SendAKite services and your monthly subscription with KITE Global LLC.
Last updated September 13, 20261. Agreement and eligibility
By purchasing a SendAKite plan, using the website, or using a SendAKite service, you agree to these Terms of Service and our Privacy Policy and Cancellation & Refund Policy. You must be at least 18 years old and legally able to enter this agreement.
2. About SendAKite
SendAKite is operated by KITE Global LLC. The platform provides phone-first tools that help incarcerated people and their families exchange permitted, consented voice messages and, where activated, routed text KITES that are read aloud after private inbox authentication; locate approved resources; and maintain authorized connections.
SendAKite is independent from correctional facilities, government agencies, bail-bond agencies, and facility communications providers unless we expressly state otherwise in writing. We do not promise access to any particular person, facility, phone system, text channel, or communications provider.
3. Verification and activation
After the customer securely saves a card and verifies the authorized mobile number, SendAKite uses the exact facility identity and booking or inmate information to evaluate the request under one common identity and safety standard. Directory and manual facility requests use that common standard, but activation occurs only after identity, provider compatibility, facility controls, customer consent, and operational readiness are confirmed. The intake standard is not a facility endorsement and does not replace facility- or provider-specific rules. You authorize us to use the information you provide for identity verification and activation.
A verified recipient identity may be linked privately across facilities or later booking identifiers for continuity. SendAKite does not expose a public name-only match result, store criminal charges for this feature, or combine independently owned sponsor connections. Multiple customers may maintain separate paid connections for the same person; each connection retains its own owner, billing, routing credentials, messages, settings, and access grants.
We may delay, limit, decline, suspend, or discontinue execution when required by law, safety concerns, inaccurate information, suspected misuse, a known closure or technical block, unavailable carrier operations, third-party requirements, or circumstances outside our reasonable control. We will not attempt to bypass technical controls.
4. Saved payment method and recurring billing
KITE Essential is exactly $19.99 per month, KITE Connect is exactly $24.99 per month, KITE Complete is exactly $34.99 per month, and KITE Premier is exactly $69.99 per month. Stripe securely saves your card for future off-session use. Mobile verification alone does not charge the card. Stripe charges the selected plan price only after the exact identity, provider compatibility, facility controls, billing authorization, and operational safeguards pass; the subscription then begins and renews monthly until canceled.
By accepting the separate recurring-billing authorization shown with your selected plan, you authorize KITE Global LLC and Stripe to save the payment method and make those charges. A separately labeled private owner-sponsored enrollment may instead authorize exactly one discounted payment and no renewal; its checkout consent controls that transaction. No tax is currently configured, and SendAKite will not silently add tax to a pending authorization. If applicable tax later becomes required, the amount and authorization process must be disclosed before charge. If the connection cannot activate, the card is not charged or any settled first payment is refunded. A future price, tax treatment, or other material subscription change requires advance notice and will not silently change the amount you authorized for a pending request.
The KITE Release Plan is available now to schedule as a verified-release transition at $4.99 per month. Scheduling is not a checkout, charge, or automatic downgrade. SendAKite will not start that subscription, replace an existing plan, or charge $4.99 until the release, identity, billing, cancellation, credential-rotation, and no-overlap controls pass and the authorized account holder separately accepts the exact recurring terms.
5. Cancellation
You may cancel a standard recurring plan at any time. Cancellation prevents the next recurring charge, and service continues through the end of the already-paid billing period unless access must end sooner for safety, legal, identity, or operational reasons. A private owner-sponsored one-period enrollment is already set not to renew.
Use the preformatted cancellation email available on our Cancellation & Refund Policy page or email support@sendakitenow.com from the address used at checkout. No telephone call is required. SendAKite will confirm the cancellation and its effective service-end date electronically within two business days. If a renewal posts after a timely request because of a processing error, SendAKite will reverse or refund that renewal.
6. Refunds
A request that does not clear the activation safeguards is not charged. If a charge succeeds but the connection cannot be activated, we will provide a full refund and initiate it within five business days after recording that activation is unavailable. After activation, monthly charges are generally nonrefundable, but if SendAKite determines the connection is technically incompatible and ends the service for that reason, we will refund the affected current period. We also correct duplicate or unauthorized charges and provide any refund required by law. The complete policy appears in our Cancellation & Refund Policy.
7. Your responsibilities
You agree to provide accurate, current information; use SendAKite only for lawful and authorized purposes; protect account and access information; respect facility and provider rules; and promptly notify us of unauthorized activity. You may not use the service to threaten, harass, facilitate prohibited conduct, impersonate another person, interfere with security controls, or transmit unlawful content. Do not submit confidential legal communications, medical details, financial account numbers, passwords, or attachments through a text KITE.
8. Communications and personalized content
To receive personal text Kites and service messages from SendAKite, the receiving phone must opt in by texting START to 502-660-0031 after reviewing the Text Kites instructions. Messages recur as conversations take place; frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to cancel or HELP for support. Senders cannot grant another phone's SMS permission. This SMS preference does not change routing-number-and-PIN access to the phone inbox.
You authorize transactional communications reasonably necessary to verify, activate, operate, support, and bill for your service. Depending on the information you provide, these may include email, telephone calls, or text messages. The separate voice authorization at signup covers automated or prerecorded account-security and contact-control calls to the verified signup mobile. That number is not used as a fallback for KITE replies. Message, call, and data rates may apply.
An outside caller using a compatible phone may submit a voice KITE by entering the connection's exact routing code, affirmatively accepting the recording and reply-call notice, recording the intended message, and pressing pound to save it. Caller ID, sponsor approval, and a recognized source number are not required to leave the outside message; a withheld or international caller may use the same flow. No PIN is required to leave the outside message. The routing code and private PIN are both required from every phone to open, listen to, reply from, or manage the full private inbox. A reply callback, when available and separately authorized for delivery, is bound to one exact KITE and callable source destination; it requires that connection's eight-digit routing code and does not request the private inbox PIN before playing the bound reply. The system does not fall back to an unrelated account contact. Voice intake may be limited by plan, frequency, provider, or technical conditions.
A signed-in app or web-app user may instead record a voice KITE after confirming the current recording and exact-reply notice on screen. That confirmation is stored as an app consent event and is accepted only for the exact account, upload, verified family number, and KITE; it does not grant general inbox access or authorize another number.
Where text KITE intake is activated, the verified sponsor mobile or another phone approved by that sponsor may submit a text KITE using the connection's exact routing code. A new phone remains blocked while SendAKite sends the verified sponsor mobile a one-time APPROVE or DENY code. A properly formatted KITE received while that decision is pending may be held encrypted and added automatically if the sponsor approves it; denial removes the held content, and the ordinary 30-day text-content limit still applies. The first line must contain KITE followed by the exact eight-digit routing code, and the message must begin on the next line. By sending that structured KITE, the approved sender represents that they control the sending number and requests one transactional automated or prerecorded reply call to that number if the exact KITE is heard and answered. Booking or inmate identifiers are not accepted as public message addresses. Text KITES cannot contain media, may be limited in length or frequency, count against the plan's combined message allowance, and are read aloud through the full inbox only after an authenticated caller enters the routing code and private PIN. Knowing the routing code does not authorize a phone or grant full inbox access. A reply call goes only to the approved number that sent the exact KITE being answered; SendAKite does not fall back to an unrelated account contact. Carrier-managed STOP, START, and HELP keywords are not treated as KITE content. STOP opts out of SMS only; it does not reroute a KITE reply. Delivery, timing, international availability, or compatibility is not guaranteed.
The account owner may invite limited Trusted Contacts for one exact connection and designate no more than one active or pending Primary Trusted Contact. The invited person must use a separate verified mobile account and invitation PIN. Primary status is a label, not a larger permission set. The owner may revoke access at any time. A Trusted Contact may view limited connection activity and update personalization, but cannot read or send private KITES, view routing credentials, change contact controls, manage billing, invite others, export the account, transfer ownership, or delete the account.
The adult account holder for a KITE Connect, KITE Complete, or KITE Premier request may select a supported spoken language, motivation style, horoscope sign or no horoscope, and an optional faith or spiritual tradition with a vetted reference or theme for the connection. Horoscope content is provided only for entertainment and reflection. Faith-based lines are optional paraphrases inspired by the clearly named reference; they do not claim to be an official scripture translation, religious authority, or a replacement for guidance from a chosen faith leader. These are sponsor-selected content settings, not verified facts or beliefs about the recipient. The signup email holder may securely change or remove them using the routing code, private PIN, and a short-lived one-time email link.
After verified release, SendAKite may preserve the account identity and eligible retained history. Existing sessions and permissions are revoked, and routing credentials are confirmed or rotated before post-release access. A transfer to another facility may change the provider route and require updated facility matching or reactivation. Access to saved messages or other history remains subject to identity safeguards, the selected plan, retention rules, facility or provider restrictions, and applicable law.
A recipient may block or pause contact directly from an incoming delivery call. A caller using the separate authenticated call-in management menu must enter the routing code and private PIN. Restoring contact requires an additional verified email link. These settings do not block direct calls placed by a correctional facility or its existing communications provider. Marketing consent, when requested, is separate and is not a condition of purchase.
9. Third-party services and guidance
Stripe processes payments, and facilities, government sources, OpenAI, and communications providers may supply, process, or control information and technical access. Their own terms and privacy practices may apply. A KITE Complete or Premier caller who affirmatively accepts the separate resource-guidance recording notice authorizes SendAKite to record and automatically transcribe the question, use OpenAI to classify and minimize it, search current public official sources, and draft a general-information response. Do not provide confidential or high-stakes personal information through that feature. Directory, resource, automated, or AI-assisted information may be incomplete or outdated and must be confirmed with the responsible official source. SendAKite does not provide therapy, diagnosis, crisis care, legal advice, medical advice, or guaranteed outcomes.
The Connected Life hub records an account owner's request and consent status; it does not itself connect, sign in to, read, or control Cash App, PayPal, Venmo, Zelle, Apple Wallet, GoFundMe, Apple Music, Instagram, Facebook, X, a correctional operating system, or another provider account. SendAKite never asks for those services' passwords, PINs, one-time codes, recovery information, secret keys, bank credentials, or full identity documents in this hub. Provider-hosted authorization, identity verification, supported scopes, and facility approval apply before any connection can be labeled active.
SendAKite is not an inmate wallet, bank, stored-value account, or facility-book deposit provider. Facility-book deposits remain with the facility's approved provider. SendAKite will not hold or route beneficiary funds, initiate wallet transfers, or deduct a service fee from a contribution until an approved payment-platform model, processor-hosted verification, refunds, disputes, reversals, fee disclosure, and applicable legal controls are operational. A public GoFundMe link does not give SendAKite access to that campaign, and any future SendAKite fee must be separately identified rather than described as a GoFundMe fee.
KITE Premier may accept supported photos and short videos into protected screening through the app or web app. Screening is not a facility-delivery claim. Photo or video delivery, DM-style computer threads, dedicated telephone numbers, email-to-message conversion, and voice-to-voice callbacks remain unavailable unless the exact carrier, facility, device, destination, sender, and recipient route is approved. Media may be scanned, moderated, size- or format-limited, retained for a limited period, rejected, or made unavailable under provider or facility rules. SendAKite will not install software inside, or bypass controls on, a facility computer or device.
AI-generated or synthetic speech is identified as AI and is not represented as a human speaker. A personal-voice feature requires verified speaker identity, explicit revocable recording and synthesis consent, documented voice rights, and a separate disclosure on each generated reply. You may not enroll or imitate another person's voice without documented authority, use a synthetic voice to deceive someone, or use it for emergency, legal, medical, financial, or identity-verification decisions.
KITE Premier includes only features expressly shown as active. Apple Music requires the user's own active subscription and is not bundled, shared through a SendAKite family plan, downloaded, or rebroadcast into calls, video, or social posts. Premier does not include full social-media feeds, silent or unsupported posting, fundraising or payout services, provider-unapproved media or computer messaging, or live human concierge service unless SendAKite separately confirms that feature is licensed, approved, and active for the connection.
10. Intellectual property
The SendAKite name, designs, software, content, and related materials are owned by or licensed to KITE Global LLC. You receive only a limited, revocable, nontransferable right to use the service for its intended purpose.
11. Disclaimers and limits
To the extent permitted by law, SendAKite is provided on an “as available” basis. KITE Global LLC does not guarantee uninterrupted operation, delivery or playback of every voice or text KITE, activation at every facility, or compatibility with every provider. Facilities and communications providers may monitor calls or messages; SendAKite is not a confidential communications channel. To the extent permitted by law, KITE Global LLC will not be liable for indirect, incidental, special, or consequential damages. Nothing in these terms excludes rights or remedies that cannot legally be excluded.
12. Changes and governing law
We may update these terms prospectively. We will provide notice of material changes affecting an active subscription and explain how to cancel. Kentucky law governs these terms, without limiting any consumer protections that apply where you live.
13. Contact
Questions about these terms may be sent to KITE Global LLC at support@sendakitenow.com or by fax at (502) 251-0729.
